I love you... I hate you... So goes the drumbeat of punditry opinion and noise regarding The Supreme’s decision in Dobbs v. Jackson : No. 19–1392. There is one thing for certain, the decision overruling Roe v. Wade : 410 US 113 (1973) is a game-changer.
The issue of abortion has been effectively running the politics of the nation for a half-century since Roe v. Wade became the law of the Land in 1973.
From a legal perspective, the decision was poorly conceived. Even Ruth Bader Ginsberg aka "RBG", while lauding the impact and result of the Court's finding a Constitutional right to abortion based upon a 14th Amendment "right to privacy", knew that the decision was on shaky legal ground at best.
Roe v. Wade and the abortion question have ruled the world of electoral politics at virtually every level since that decision was delivered on January 22, 1973. Unfortunately for those who are passionately Pro-Choice, it destroyed their political game. How? Because the reliance on the Constitutionally questionable decision allowed the “Pro-Choice” team to rely on their Roe Kryptonite to protect them without ever having to persuade the United States Congress from passing a national abortion law. There is no doubt that would have been a gargantuan task, although they had 50 years to do it, and never had to try. We all know what Kryptonite did to Superman, right?…
The Dobbs decision sent the question regarding abortion regulation back to the states to decide the legality and parameters of abortions. Obviously, the impact of Dobbs will be profound. However, once sent back to the states it will be far from predictable…
Counterintuitively, some of the most significant surprises will likely occur in "Blue" states. The Democrat Party has never been forced into supporting its position regarding abortion and the degree to which a woman has a right to choose. Accordingly, Democrat and Independent voters have rarely been provided any information regarding what "Pro-Choice" means to their elected polls. The Dem Pols have never been forced to reveal that most have taken the absolutist approach to the "My Body. My Choice” mantra and advocate for full-term abortion.
The Democrat Industrial Complex (DIC), along with The American Pravda, as usual, have reverted to their hateful white male screed regarding the Justices who voted to overturn Roe v. Wade. Much of the DIC and American Pravda, have encouraged violence in the streets and death threats to the Justices voting to overturn Roe.
The most disgusting propaganda comes from Joe B. who has proclaimed that the Supreme Court has declared a national ban on abortion. Dobbs v. Jackson, by overruling Roe, sent the question regarding the legality of abortion back to the states. Their decision was constitutionally correct. Obviously, the decision was one of monumental impact, however, Courts don’t make laws, they are there to interpret them.
There will never be any consensus, or convergence of opinion to reconcile those who are "Pro-life" or "Pro-Choice". In the end, those questions need to be resolved the old-fashioned way, at the ballot box, not by the bench.
